The following employees or classes of employees or other workforce members under the control of the Plan Sponsor may be given access to PHI received from the Plan or a health insurance issuer or business associate servicing the Plan:
Employees of the Department of Finance and Administration, Office of Insurance:
This list includes every employee or class of employees or other workforce members under the control of the Plan Sponsor who may receive PHI relating to payment under, health care operations of, or other matters pertaining to the Plan in the ordinary course of business.
The employees, classes of employees, or other workforce members identified above will have access to PHI only to perform the Plan administration functions that the Plan Sponsor provides for the Plan.
The employees, classes of employees, or other workforce members identified above will be subject to disciplinary action and sanctions, including if appropriate, termination of employment or affiliation with Plan Sponsor, for any use or disclosure of PHI in noncompliance with the provisions of the Plan Document. The Plan Sponsor will impose appropriate disciplinary action or sanctions on each employee or other workforce member causing the noncompliance and will work to mitigate any deleterious effect of the noncompliance on any participant or beneficiary.
